1. Acceptance of These Terms
By accessing or using MacNerd.xyz (the “Site”), owned and operated by Neochrome Inc. (“Company”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree, please do not use the Site.
2. Eligibility & Account Creation
You must be at least 18 years old to create a MacNerd account and post comments.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
3. User‑Generated Content
When you submit comments, you grant the Company a non‑exclusive, worldwide, royalty‑free licence to display, reproduce, and distribute that content in connection with the Site.
You must not post content that is unlawful, defamatory, harassing, hateful, or infringes anyone’s intellectual‑property rights. We reserve the right to remove or modify user content at our sole discretion.
4. Intellectual Property
Unless otherwise noted, all articles, graphics, tools, and software on the Site—including the Mac Recommendation Engine and Mac Comparison Tool—are owned by the Company or its licensors and are protected under U.S. and international copyright laws.
Occasionally we may embed videos as allowed by their creators from YouTube. Those videos are owned and copyrighted by their original content creator. Viewing of embedded YouTube videos are bound by Google’s terms and conditions. If you do not agree, please do not use the site.
5. Third‑Party Services & Links
The Site integrates Google Analytics (audience measurement and performance) and Rank Math SEO (search‑engine optimization). External links and embedded services are provided for convenience; the Company is not responsible for third‑party content or practices.
6. Disclaimer of Warranties
The Site and its content are provided “as is” without warranties of any kind, express or implied. Use the information at your own risk.
7. Limitation of Liability
To the maximum extent permitted by law, the Company will not be liable for any indirect, consequential, or special damages arising out of or relating to your use of the Site.

These Terms are governed by the laws of the State of California, without regard to conflict‑of‑law principles. Any disputes shall be resolved by arbitration to be located in Los Angeles County, California.

This Privacy Policy explains how MacNerd.xyz, DBA Neochrome Inc. (“we,” “our,” or “us”) collects, uses, shares, and protects information when you visit the Site, create an account, leave comments, or sign up for our newsletter.

3. How We Use Information
We use information to provide and secure Site functionality, moderate comments and prevent spam, analyse traffic and improve content relevance, send newsletters and promotional updates if you opt in (you may unsubscribe at any time), and comply with legal obligations.

How to exercise your rights: Submit a request via macnerd@neochro.me. We will verify your identity (email confirmation for account holders; reasonable verification for others) and respond within 45 days. We honor the Global Privacy Control (GPC) signal as an opt‑out preference for sale/sharing.
7. Do Not Track (CalOPPA)
At this time, we do not respond to standard “Do Not Track” browser signals, but you may use GPC as described above.
8. Data Retention
Account information persists while your account is active. Comment metadata is retained to maintain discussion context unless you delete your account and request removal. Analytics data is stored in aggregate form for up to 26 months (Google Analytics default) and then automatically deleted.
9. Security
We employ HTTPS encryption, firewall protections, and least‑privilege access for administrators. No method of transmission or storage is 100 percent secure; use the Site at your own risk.
10. Children’s Privacy
The Site is not directed to children under 13. We do not knowingly collect personal information from children. If we learn we have done so, we will delete it promptly.
11. International Users
The Site is operated from the United States. By using it, you consent to the transfer of your information to the U.S. and to our processing under U.S. laws.
12. Changes to This Policy
We may update this Privacy Policy periodically. Material changes will be posted on this page and, if significant, announced via email to registered users.
